Fazo Terms and Conditions
Version 1.0 — DRAFT PENDING LEGAL REVIEW
1. Who we are
1.1 Fazo is operated by [CAMEL PROPERTIES (PTY) LTD], registration number [REG NUMBER], with its registered address at [PHYSICAL ADDRESS], South Africa ("Fazo", "we", "us"). Contact: [SUPPORT EMAIL].
1.2 These Terms, together with our Privacy Policy and Fees page, govern your use of the Fazo platform ("the Platform"). By creating an account you accept these Terms.
2. What Fazo is (and is not)
2.1 Fazo is an online marketplace that enables private individuals to list, discover, and buy second-hand and other goods from each other.
2.2 We are not a party to any sale. Every sale is a contract directly between the Buyer and the Seller.
2.3 We do not hold your money. Payments made through Safe Pay are held by TradeSafe Escrow (Pty) Ltd, an independent escrow partner. TradeSafe's terms apply at tradesafe.co.za.
3. Eligibility and accounts
You must be 18 or older and hold a South African bank account (for Sellers) to transact. Before listing or buying, you must complete Bank Verification through TradeSafe.
4. Listings and Seller obligations
Sellers warrant accurate descriptions and lawful sale. Prohibited items include stolen goods, weapons, illegal drugs, live animals, and anything unlawful to sell in South Africa.
5. Safe Pay (escrow)
5.1 Buyer pays into TradeSafe escrow; once funds clear, parties may exchange the item.
5.2 Inspection window and auto-release. After handover, the Buyer has 48 hours to release payment or raise a problem. If neither, payment auto-releases to the Seller.
5.4 Only Safe Pay is protected. Off-platform payment voids all protection.
6. Fees
6.1 Buyers pay the listed price only. No Fazo fee is added at checkout.
6.2 Sellers pay a Safe Pay success fee as published on our Fees page (currently 5% of the sale price, minimum R1), deducted automatically from the sale proceeds when payment is released. Current fees are always published on our Fees page; we may change fees on reasonable notice, applying only to future transactions.
7. Disputes
Problems freeze funds while disputes are handled. TradeSafe's dispute procedure may apply. Consumer Protection Act rights are preserved where applicable.
8–12. General
Meet in public places for in-person exchanges. We may suspend accounts for Terms breaches. Liability is limited as permitted by law. South African law governs. Material changes require re-acceptance.
This is a skeleton for attorney review — placeholders remain for company registration, support email, fee VAT status, and escrow cost allocation on cancelled deals.
