Fazo Terms and Conditions

1. Who we are

1.1 The Fazo online marketplace ("Fazo", "the Platform") is operated by CAMEL PROPERTIES (PTY) LTD, registration number 2026/228653/07, with its registered address at 17 New Church Street, Cape Town, Western Cape, 8001, South Africa ("we", "us", "our"). The Platform trade name is Fazo. Support: support@fazo.co.za.

1.2 These Terms, together with our Privacy Policy and Safe Pay fees page, govern your use of the Platform. By creating an account you accept these Terms.

2. What Fazo is (and is not)

2.1 Fazo is an online marketplace that enables private individuals to list, discover, and buy second-hand and other goods from each other in South Africa.

2.2 We are not a party to any sale. Every sale is a contract directly between the buyer ("Buyer") and the seller ("Seller").

2.3 We do not hold your money or payment credentials. Payments made through Safe Pay are held by TradeSafe Escrow (Pty) Ltd ("TradeSafe"), an independent escrow and payment partner. TradeSafe's terms apply at tradesafe.co.za.

2.4 Fazo provides technology, messaging, and dispute tooling. We do not guarantee the quality, safety, or legality of items listed by users.

3. Eligibility and accounts

3.1 You must be 18 or older to use the Platform.

3.2 You may browse listings without an account. To list, chat, make offers, or buy through Safe Pay you must register and keep your account details accurate.

3.3 Bank Verification through TradeSafe is required before a Seller can receive offers on listings and before a Buyer can pay into Safe Pay escrow. ID or passport and bank details are collected only with your explicit consent and are sent directly to TradeSafe — see our Privacy Policy.

3.4 You are responsible for keeping your password confidential and for all activity on your account.

4. Listings and Seller obligations

4.1 Sellers warrant that descriptions are accurate, that they have the right to sell the item, and that the sale is lawful in South Africa.

4.2 Prohibited items include stolen goods, weapons, illegal drugs, live animals, counterfeit goods, and anything unlawful to sell. We may remove listings and suspend accounts without notice.

4.3 Listing locations shown to Buyers are approximate for privacy — exact addresses must not be shared in chat (see section 5.5).

5. Safe Pay (escrow)

5.1 When a Buyer pays through Safe Pay, funds are deposited into a TradeSafe escrow account. Once funds clear, the Seller may hand over the item subject to the release process below.

5.2 Inspection window and auto-release. After the Seller marks the item as handed over and the Buyer confirms receipt (or verifies the handover code), the Buyer has 24 hours to release payment or raise a problem. If neither happens within that window (where auto-release is enabled), payment may auto-release to the Seller.

5.3 Release codes. For funded orders, the Buyer receives a release code to confirm handover at exchange. Do not share release codes except with the Seller at handover.

5.4 Only Safe Pay is protected. Any agreement to pay cash, EFT, or other off-platform methods voids Safe Pay protection. Chat messages attempting to move deals off-platform may be blocked automatically.

5.5 In-app communication. To protect Buyers and Sellers, our chat system blocks phone numbers and references to WhatsApp, Telegram, Signal, and similar apps. Arrange meetups and Safe Pay steps inside Fazo.

5.6 Cancelled or failed payments. If a payment fails or a reservation expires before funding, the listing may become available again. TradeSafe gateway fees on unsuccessful attempts, if any, are governed by TradeSafe's terms.

6. Fees

6.1 Buyers pay the listed or accepted offer price only. No Fazo fee is added at checkout.

6.2 Sellers pay a Safe Pay success fee as published on our Fees page (currently 1% when the buyer pays from Safe Pay balance, or 5% for card/bank (minimum R1)), deducted automatically from the sale proceeds when payment is released. Buyers are not charged a separate platform or bank fee at checkout. Current headline rates are always on our Fees page. We may change fees on reasonable notice; changes apply only to future transactions.

6.3 How the fee is calculated. The Safe Pay success fee is 1% when the buyer pays from Safe Pay balance, or 5% for card/bank (minimum R1), rounded to whole rands, and is deducted from the Seller's proceeds when payment is released (not added on top for the Buyer). Examples: on a R200 sale the fee is R10 (Seller receives R190); on R600 it is R30 (Seller receives R570); on R1 500 it is R75 (Seller receives R1425); on R5 000 it is R250 (Seller receives R4750).

6.4 Escrow, gateway, and cash-out. Safe Pay holds the Buyer's payment in a Standard Bank-supported escrow account via TradeSafe. Fazo never holds card details or operates as the escrow bank. Payment-gateway (card/Ozow/EFT) costs charged by TradeSafe to Fazo are not passed through as an extra Buyer surcharge. After release, the Seller's net is held in their Safe Pay balance. When the Seller cashes out to a bank account, a bank cash-out fee applies as published on our Fees page (currently R5 per cash-out), charged by TradeSafe on withdrawal — not as an extra fee on every individual sale. Gateway costs do not change the Seller net shown when listing or accepting an offer.

6.5 VAT. Safe Pay fees are quoted inclusive of any VAT payable by us where applicable. TradeSafe fees are governed by TradeSafe's merchant agreement.

7. Disputes

7.1 Either party may raise a problem on an order. Funds may be frozen while a dispute is investigated. TradeSafe's dispute procedure may apply.

7.2 Nothing in these Terms limits rights under the Consumer Protection Act 68 of 2008 where applicable.

8. Acceptable use

You must not harass other users, post unlawful content, attempt to circumvent Safe Pay, scrape the Platform, or interfere with security. We may suspend or terminate accounts for breaches.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or user conduct. Our aggregate liability for any claim relating to the Platform is limited to the Safe Pay fees we earned from your transactions in the 12 months before the claim, except where law prohibits limitation.

10. Privacy and data

We process personal information under the Protection of Personal Information Act 4 of 2013 (POPIA). See our Privacy Policy for details, including how to access or delete your data.

11. Changes

Material changes to these Terms will be notified on the Platform and may require renewed acceptance before continued use.

12. General

Meet in public, well-lit places for in-person exchanges. South African law governs these Terms. The courts of South Africa have jurisdiction, subject to mandatory consumer forums where applicable.
